Excess Ballot

Primary definition

A cast in excess of the number of voters who appeared at the polls. The states differ BALLOT on what do to when it is determined that excess ballots have been cast. Unfortunately, it is not feasible to determine which ballots are the ones in excess. The most common resolution is to replace all ballots in the ballot box and draw out and destroy or sequester that number of ballots equal to the excess. S.D. Rules §5:02:16:09.
