HAVA requires that a voting system used in an election for Federal office have an error rate that “shall comply with the error rate standards established under section 3.2.1 of the voting system standards issued by the FEDERAL ELECTION COMMISSION” in effect on the date of enactment of HAVA, that is, 1 in 500,000.
